H1 B and OPT question

I came to US and completed MS here. Got my OPT starting from Aug 2006 for 1 year. My new company (Company A) sponsored me H1 and mine H1 got approved effective from 15 Dec 2006. But, the company (Company A) laid me off on 30th Oct 2006 before the effective date of my H1. I am here in the US without a job from Nov till date and just I just got a call from new job today.



Under this scenario, how does it work? Can I use my old OPT to join the new company or can I transfer my old H1 for the new job?



I am much tensed. Can you guys please suggest me?

Your OPT expires only Aug 2007, you should have applied your first H1 with effective date after the OPT expiry. But you did not do that. Now you are in H1 without a job (no pay stub) from 15 Dec 2006 to present.

If you get a job offfer you can transfer your H1 but transfer come with out a status, means you must go out to get your H1b visa stamped in your PP and re enter with H1 status (valid I 94 with caveat h1b) to start working with company B.
