H1-B and Maintaining Status

My work visa has been approved (start date October 1).

I am in F-1 visa. When can I stop going school? Do I need to keep my student status until September 30? My lawyer says I do not have to maintain my student status anymore. Do you think he is right?

Please let me know what the law says.

At this moment, I'd say you have to maintain status til Sep 30.
I think what your lawyer said was interim rule applied only in 2004.

Thanks GotPR. I posted same question to other forums too and everybody says I need to maintain my status including some lawyers who answered my question. Can I maintain my status this way?

I started my master's degree in Jan 2007. I will complete my first semester this May and I will take the summer break. My fall semester does not start until August 27th. It looks like I need to be in status for 1 month and 3 days after my summer break.

Can I register fall classes (9 credit hours) until September 30 and drop them all that day? Do I have to attend classes to maintain my status or registering classes will do?

I am thinking about relocating to the state where my future employer is located this summer and I do not want to come back to school for 1 month and 3 days.

If I have to attend the classes to maitain my status, I would like to finish the fall semester (If I take one class over the summer, I can actually graduate in December 2007. In that case, my question for you is, if my employer is ok, can I start my job in Jan 2, 2008 instead of Oct 1, 2007.

Please let me know.

Once you have your visa you are free to commence work on the date that you & your employer decide. So yes, you can start on Jan 2, 2008.

If you can graduate by December 2007, come on, don't be silly. Finish the school.

If your employer is ok with it, you can start any time after Oct. 01.

If I did not start on October 1, what are the consequences I may have to face in the future?
