H1-B and deferred prosecution

I have an H1-B that's about to expire this month.
My employer has obtained for me a second H1-B, and now I need to change the visa stamp.

My problem is that I was arrested for DUI, and now I'm in deferred prosecution program (which basically mean that my case is on hold, I haven't been convicted of anything).

Will this going to affect my visa stamp change request?.
Do anybody know how INS is looking at this?.

If you are convicted, there is a probability of your deportation. However if this was a simple straight forward DUI, deportation might not happen.

Visa extension/transfer will not be affected by this conviction. But all felony offenders, after conviction will be deported immediately.
