H1-B 6 yrs expiring...pls.help

Hi,

My 6 yrs on H1-B visa are expiring in Jan 2004. I am working with company A and they have filed my LC and it is pending from 18 months(date has not moved at all).
Now another company B is ready to file my H1-B and LC from some fast state and I am planning to quit company A .

Pls advise me on the following :-

1) What will this company do for H1 - will it be a H1-B transfer or 7th yr H1 extension ?

2) Can this company B file a new LC based on pending LC from company A.? What docs are needed for this?

Also my present company A has only given me my case number(on attorney letterhead ) of LC and I don't have any other docs.

Pls. advise me.

---- It will be H1 transfer if you apply now. You can apply 7th year extension any time before Jan 2004
2) Can this company B file a new LC based on pending LC from company A.? What docs are needed for this?
----- No, Company B can not file LC based on pending LC through A . Company B has to file new LC for you.
you can go for H1 transfer,For H1 transfer they only need recent pay stubs, for 7th year extension you need the copy of letter that was sent to your lawyer or employer by SESA after your LC was filed that has your PD and case # on it
Also my present company A has only given me my case number (on attorney letterhead) of LC and I don't have any other docs.
---- Ask for the copy of SESA letter because that is the evidence BCIS will accept not the lawyer letter

"If you can get the proof of LC sumbission from Company A, you can use that to get 7th year extension while transferring the H-1. You need to confirm with your lawyer but this is what I understood."

2) Can this company B file a new LC based on pending LC from company A.? What docs are needed for this?

" Company B cannot file LC based on Company A's LC, both are independent."


"btw, make sure you have enough window to get the LC and apply for 7 the year extension before your H1 expires."
