H1-b 129 Application financial statement Gross annual income

Hi All,

My H1-B is going to expire end of Jan 04 and it's now time for me to extend my H1-B. Currently my company's financial statement shows a loss. If I apply H1-B extension will I get it? Also the company is doing my I-140 process if I get query on the company's financial statement when I do my H1-B extension (due to the bad financial status) are there any chances of my H1-b and I-140 being rejected? (Note: At that time of filing my I-140(July2003) my company was finacially on profit).

For H1-B extension form I-129 asks about company's Gross and Net income. The Net income of my comapany is negative and so USCIS will know my company's financial situation.

USCIS only cares about the company's ability to pay salaries.
