Hello!

I will appreciate if you could answer some H1 stamping related questions.

I recently got my H1B approved by INS. Before that I was on F1 visa for 5 years. I am planning to go to Canada in the next month and was thinking of getting my visa stamped at the same time. The lawyer of my company is a little paranoid and is saying that getting visa in Canada or Mexico is very difficult these days and one should not even bother. The problem is that once the visa in Canada is denied people cannot come back to the US.

I am in a fix as I want to go but am not sure after knowing this. Could you please tell me what is the scenario and if someone had a bad experience recently. Moreover if there is a problem, how long does one need to stay in Canada before the visa is granted?
 
Unless you are from one of those countries blacklisted (the 20-day waiting period is removed, security clearances are not) your H1 stamping will be denied in Canada (Mexico is out of the picture now).
With a US degree Canada is a better choice. For TCNs they will deny the visa in a day or 2. The only alternative is for you to go to home country and get the H visa. Be prepared for that contingency.
