Hi ,
My wife's H1B application is approved and she got a I-94 from 1 october 07.
Currently she is on H4 .
My H1 her H4 and our current I-94s are expiring on 14th Sept 07.
I will be filling for extension soon ,my question is do I need to file I-539 for my wife as well.
If we file for her H4 extension,will she get one more I-94 along with it.?
also as her H4 extension will be approved after her H1 approval will she go back on H4 loosing her H1 status.(I hope that isnt the case).
I need to file her extension otherwise she will be out of status for 15 days gap.
Please suggest/clarify.
