My H1B was filed and approved in 2008 but unfortunately the company was dissolved before Oct 1. I am applying for a cap-exempt H1 and going to work in a univ. for time being. If a company wants to hire me before Oct 2009, will I be subject to H1B quota again?
It depends whether you were counted against the cap or not. If they withdraw your petition and your number is freed up, any subsequent H1B would be under the cap again.
Thanks nscagony. I was counted against the cap this year. Now, if the company is no more in existence, doesn't the petition become inactive anyways? What do you mean by withdrawing the petition?
