H1 Approval With Misdemeanor case still in progress

Hello all.
I'm on OPT and my client is willing to hire me fulltime. and they are sponsoring me this April.

But i have a Misdemeanor case which is still in progress.

In such scenario will i Get H1 Approval?
Does the misdemeanor case show up in my background check?
