Hello all,
I am in a tricky situation. I came in with an F1 to do Master's in Computer Engineering. I didn't finish the course and currently stand at a 2.83 GPA which doesn't qualify me for getting a degree. I got a job when on OPT and later transferred to H1B. While filing for H1B the employer had declared my credentials as Master's in Computer Engineering. Idea at that time was I will finish my degree and then go for stamping. H1 was approved. Not only that when I changed my employer and applied for a H1 Transfer ...that was approved too.Since I have not been an active student for almost 3 years and with a 2.83 GPA my university might not allow me to continue MS and finish it. I have been employed for last 2years and 3 months.
Now I need to go to get a stamp on my H1 as I want to goto India for vacation.
Should I be worried of rejection for my H1. Can I goto MEXICO/CANADA and get stamped. Please advce!!!!!

Not to scare you or anything .... but from what I've read, you have a high chance of getting into trouble at the consulate.

Your H1 approval is presumably invalid since you don't have the qualifications that were required per the LCA.

I think you'll have trouble irrespective of where you go. Not only that, but when u apply for H1 extension, you'll have issues too.

I think its high time you consulted with a good immigration attorney.
