-Came to US in 2001 on F1
-Completed MS and started working on H1 in 2004, present status is H1 per I-94
-Never had H1 stamped in my passport, never visited outside US since 2001
-Received AP, when my employer applied for my adjustment of status
-AOS still pending and my take some more time
-Planning to visit my country, get married, and come back using AP as I don't have H1 stamped in passport
-Once I use AP, my status will change to parolee and will no longer be H1
-My current H1 is valid till OCT 2008

Can I apply for H1-premium (extension) from my current employer right after coming back to US in 2007? (I want to do this to change my status from AP to H1 so that my wife can aply for H4)

Any issues/suggestions?

waiting for other,s inputs. Please correct me.
1- when you go to your home country, try to get H stamp and show them the AP, mostly you will get the stamp easily and use it when you return back. If any delay could happen, just come and use your AP
2- Using the AP will not invalidate your H, using EAD will. If you use AP you are still H visa.
3- If you invalidate your H (e.g by using EAD) and later on you want to return back to your H status, you have to leave the US to get stamp from outside. It is not like change F to H where you can do that without leaving the US.
4- If your green card get approved any time before you marry, the situation will be totally different. Your H will expire in the same day of green card approval and bythen to give your wife a GC will be much more difficult.
