H1 and H4 extension

Hi,

My H1 expires in 4 months( end of jan 2004, 6 years will be completed), my wife's h4 expires on dec. 1st 2003 (both i94 and visa stamp), I have applied for LC on sep 2002, How soon should i be applying for H1 and H4 extensions, and how much time does it take.

You both should send your applications to extend H1 and H4 with BCIS. One can file for extension 6 months advance. File your wife H4 extension in the same envelope of your H1 extension. These days it is taking 4-6 months for extension and depends on service center

**** Talk to your lawyer you may have to get 7th year extension if LC was filed 365 days back and you need the evidence that LC was filed 365 days back it can be letter from SESA or SWA with your name and case #
