H1 and fellowship

Hi,
I am currently on H1 visa in 3 year Peds residency following which I will be doing a 3 yr fellowship in peds subspecialty. Can a firm start processing my GC during fellowship for the subspecialty I will be finishing , or do I have to be board certified for that position, which means can they only start processing for general peds.What are my other options?Thanks
 
So, I guess you are the lucky person who managed to get a fellowship on H1b !

If you plan to apply for GC through labor certification, your future employer can only apply for this once you fulfill the requirements specified in the application, whatever they may be:

If job posting and ETA750 says: neonatologist ---> must be eligible to sit for neo boards.

If job posting and ETA750 say: pediatrician ---> board eligible for peds

If job posting and ETA750 say: pediatrician with at least 1 year of additional experience in neonatology in order cover L+D in the absence of the levelIII NICU director and to become director of the levelII nursery. ---> board eligible for peds and 1 year into neo fellowship.
Your employer can write job requirements in there that are 'reasonable and consistent with the nature of employment' (or something like that). Speaking fluent farsi, is not something that can be justified. Having neo experience, if the job description is properly groomed can pass that test.



Of course, your prospective employer can sponsor you as 'pediatrician' once you are out of residency. But with the glut of pediatricians on the market, it might be challenging to create an 'honest' RIR or PERM filing (no matter how desolate you make the job sound, there will allways be a couple of desperate colleagues happy to take that 135k job)

Thank you. That means I can still get a sponsor in the peds-subspecialty as long as I am board eligible, I do not have to be board certified by the time I apply

could u pls let me know hwo did u go by getting h-1b ......

did u go thru match and then got a h-1
or was it directly without going thru match??
