H1 8th year ext ? Please help

Folks, My H1 6 year limit ends on 03/05/2004 .I recently got my 7 th year extension which is valid till 02/28/2005 on basis of pending labor. My lawyer told me that their is NOF in my labor case and case will need to be withdrawn .

So they filed another labor on 03/03/04. Now my question is that since my H1 7th year ends on 02/28/05 and 365 days for pending labor will complete on 03/04/05 , will I be able to get 8th year extension ? since I will be 4 days short of 365 days pending ? Has anyone been in similar issue?

Any Advice / information . Please help.

---- Can’t your lawyer/employer reply to NOF? Or satisfy NOF?

----- Dear only your lawyer can give you a better advice what to do in this scenario. If I am in your situation I would find approved LC that matches with my skills, education, EXP at the date that particular LC was filed. If you can find the approved LC with ANY employer then enter a deal and file I-140 with labor substitution along with I-485, EAD, and AP

----- Try it this best option for you, they can send RFE for any kind of petition so don’t worry about RFE it is routine these days, many compnies have approved LC try to find them through friends

------ You lawyer will be the best to give you advice make him of your concerns and good knowledgeable lawyer can make or suggest a good strategy.

I have noticed that UCIS is not extending 3-4 weeks time to recapture and many got denied. ask what your lawyer and follow him if you trust him if you dont trust him go to other lawyer
