H1 7th Year extension: 140 approved

Can I file for H1 7th extension even though my I-140 is approved?
If yes,when should I apply now or 2/3 month before h1 expiry?
I need to maintain my H1 so I can file my wife's papers.
Any help is appriciated.

You need to maintain your H1 status. I don't know what the current waiting time is for H1's. My company usually file 3 months in advance. To be on safer side, you can try filing it 4 months in advance, other members with H1 extensions can post there approval time.

You can file your I-129 and your wife's I-539 any time before your I-94s expire. If USCIS gets the renewal the very day before expiry, you're still fine.
 
Why don't u file for 3 year incremental H1B as per the recent AC 21 clarification. Hope you are affected by the retrogression's country cap limit. If then, you may be eligible for 3 year incremenatal H1B extension.

I am going to file for my h1 extension in couple of days. I'm going for 3 year extension.
1.Can they deny 3 year extension?
2.if they deny 3 yr extension will I be given a 1 year extension or no extension at all?
3.Is it safe to go for 1 yr extension only?
4. H1 expiring on 15th Dec 2005.
My I-94 exp. date : 25th Dec
Wife I-94 exp. date: 15th Dec
Can we stay after filing for extension even if the extension is not granted by above dates?

I need to maintain my H1 for my wife’s I-485 filing.

All inputs are appreciated.

You should not have problem to get 3 year extension.
Don’t forget to include your 140 approval notice in your package. If you want to highlight your situation to be safer for 3 year extension, you can put a cover letter to quote the Yates’ Memo and stress your PD is not current to file 485.

That is the issue...i have already filed my 485 back in june 2004...
it is for my wife i'm unable to file 485.

will i be able to get 3 yr extension in this situation?
 
I am in the same boat here.
Just wanted to add another question - how about and H1 transfer can you do that?
