6 years on my H1 is expiring in Jul,03. I have applied for labor certification from corporate office PA(I live in SC columbia). I have applied for my labor on May15,2001.
Now My lawyer has agreed to apply for my 7th year extension based on my pending labor. I have asked for premium processing program. He said - it is not required to apply for extension in premium processing program. He is saying as long as H1 employee files for extension, INS will extend based on pending labor.
If my application is submitted sometime in March(next month), Texas service Center will take around 5-7 months to process it.
Is it legal to work during that period with the reciept in hand?
My lawyer is saying - he is going to start my columbia labor as well.
If by any chance, my phildelphia labor gets cleared during this period - does my 7th year extension stays good? so that I can wait for my columbia labor to clear?
