Hi
I am in the 6th year of my H1. Current H1 is due to expire in June 2006. My company filed for my Permanent labor in Nov 2004. Now the problem is my company is in trouble and may close the business or if some one buys we might be out of the job. If company closes they are going to withdraw the Pending permanent labor and cancel my H1.
If I get an offer from another company, can I get 7th Year extension based on the current permanent labor filing date. Can I use this even if the existing company withdraws my labor ?
If the new company files PERM immediately and in case if my EB3 PERM is approved before June 2006, can I still get my 7th year H1 extension ?
Appreciate if Gurus & Senior members let me know all the possible options for me.
