Hello All !

I really appreciate your interest in looking at my question ..

Actually my H1B sixth year limit ends in Dec 2003 . Labor was filed in April 2002 in Texas , So far labor was not certified and my company is applying seventh year extension for me based on labor was filed a year before .

My company is not in a good financial condition right now . If due to some reason if they stop running the company , What z my situation .. I mean whether i can join some other company with that extension ?? Since my labor was filed with current company can i apply the extension with some other company or not ??

I hope i explained it properly ..Looking forward to hear from you all ...

Thanks,
Shyam

yes you can apply 7th year extension from new company using the labor filed with current or old company. note that the labor should have been filed before 365 days and either labor or i140 should be active. your current employer should not cancel that labor or revoke i140. if the employer is cooperating then you are ok.
