Hi,

My H1 (Six Years) is getting over by the end of Aug 2003. I have applied for a leave extension for 3 months. What will my status be if INS rejects my leave extension ??. Will I be Illegal, or will I be in status .Also will I have enough time to pack my bags and leave ...What is the procedure ....

Your help would be appreciated.

Thanks

I AM ALSO IN THE SAME BOAT.

I am assuming that ‘Leave extension’ means recapturing the time spent outside US. My H1B 6 years expiring in Sept 2003, My Lawyer will apply for the extension for 64 days in this month end or next month beginning.

Hope my LC will be cleared within 3 months so that I can apply for I140/485 concurrently.

Thanks,
Ashkar.

HI Poppyjoy,

I think your extension is based on your personal trip and it is not related to business trip. Am I correct?

Did you apply the extension to Vermont Service Center?

Could you please write the documents submitted to BCIS?

Thanks,
Ashkar.

If BCIS rejects your application you have to leave, generally it sends a notice to deny, so you can prepare.

Is there a time limit, or do I have to leave immediately. Also, I am pregnant and the Drs have clearly told me not to travel because of complications. Can we send a document to INS and ask for an extension ???. Thanks
