Hello gurus,

I'm in a rather strange situation.

Last month my employer filed H4 extension for my wife based on my pending H1 application.

Yesterday I got an RFE from TSC asking us to prove the relationship between <my wife> and <xyz>, where xyz is a complete stranger for us.

It also says that the H4 was filed based on pending H1 of <xyz>.
And I'm sure I wrote my own name in the H4 application form I sent to my employer.

Only thing I doubt is that I left the I-129 receipt number and date blank for my emplyer to fill in. they told me that they filled in the info and filed I-539.

Any guess what's happening? Did my employer enter the wrong receipt number? Or could it be a mistake on TSC's part?

In either case, what is the remedy?

Its more likely that your employer messed it up. Talk to your HR Dept...usually they make a copy of all the docs submitted. If everything looks correct, then its TSC mistake.
 
It seems your employer mistake and some one from Hr filed H4 with out full knowledge how to file H4 extension and they wanted to save and did not take the help of lawyer, did you also sent your spouse I-94 copy (both the sides) marriage certificate, her relevant passport pages, and Form I-539 was supposed to be signed by your spouse and on one page of I-539 it has to be written how H4 holder is being supported and normally husband name and company info and salary info is provided and it is stated that my spouse supports me.

----- Provide the copy of marriage certificate, your wife passport page that has your name as spouse and also provide the passport pages that has earlier H4 visa stamp and entry stamp

I did fill out all the information correctly. My wife signed it and we wrote the same things that Ginnu mentioned. As I did not have my H1 receipt at that time, I left that space blank and asked my HR persons to fill it.
Our passports do not have spouse names on them.....

Today my employer called me and told me that they have gone through the docs and all the information is correct. They said they mailed two applications together(one for my wife's H4 and one for some body else's H1) and that might me the source of confusion. They say it is INS' mistake and they will send a letter to INS to clarify this.

But I'm still worried.

And you are right, they did not take the help of a Lawyer !!!
