H-4 wife cheated

Hi,

I'm divorcing my wife of 7 years, which I've provided love, respect, support and pending I-485 for. Because she's been seeing another man while im working my back off everyday ,which caused me a great pain and depression.
I'm trying to get her deported and also report her working illegally.

The I.C.E number put me on hold forever.
I can't report her to IRS because it would trace back to me (joint tax return).


Please let me know your ideas,

They're not going to deport her for cheating. I don't think you can do anything to revoke her H4 until the divorce is final.
 
well, not for cheating, I know that's a personal issue.
The divorce is finalizing, i'll look into revoking H4

be a man and move on. Divorce her if you want and let her live her life. You only told us that she cheated on you but forgot to mention why, may be you are the problem. I am not saying it is easy but I advise you to start a new life.
 
If she really wants to stay back she always can by hiring an attorney and going to womens organization saying that you abused her and stuff and get a battered spouse I-360 approved under VAWA act and you know she can even get her work permit from it.

As GCman2005 said just move on, it doesn't matter where she lives after you divorce her.
 
I know you feel hurt but it's better to just move on, no point in expending more time and effort in seeking some sort of revenge, it'll just aggravate you more and keep you further away from regaining your peace of mind.

No she cannot, because the original poster is not a US citizen or permanent resident. The battered spouse I-360 is used to substitute in cases where an I-130 was filed. The OP cannot file an I-130 for anyone.
 
I agree with RealCanadian. Since she does not have a green card yet, she can not claim asylum here or claim permanent resisdency under VAWA. WHile you are on H1B, your employer is primary beneficiary with you being secondary beneficiary. Your wife is only the tertiary beneficiary. If your divorce is finalized before you two get your green cards, there is nothing she can do to get permanent residency based on your application.
Just a friendly advice - Make sure you stay away from her, donot (even if she provokes you) ever use any force against her and get the divorce finalized asap. The day the decree is signed, her status will be illegal here. You donot have to do anything. Time will take its course and a later stage, she may herself land in trouble if she continues to stay here illegally.
