Me and my Wife's Visa and I-94 expires in Feb 2005. My company filed for my H1 extension and I have recieved my approved I-797 . Unfortunately, me and my company forgot to file for my wife's H4 extension.

I am planning to go to Toronto for getting my and my wife's Visa stamped, 3 week's before our Visa expires. I have two more H1B visa stamped on my passport.

My queries:

1) Could their be a problem with my wife's Visa approval as she doesnot have an approved I797 and that she is not filing from her home country.

2) How long can the consulate take to decide on her and my case

3) What unforseen things can we be prepared for ?

------- you can file your wife H4 extension with form I-539 before her I-94 gets expired

---- at present she has valid status becase her I-94 is valid

-- only consulate knows this or search the other threads

----- if visa applied and it gets rejected in Canada you will not be allowed to enter back to USA from Canada and you need to go directly to your home country from Canada to to get Visa stamping and then enter US with valid Visa stamp.

**** your wife has valid I-94, your new H1 transfer approval may be having I-94 attached and extended. why you need Visa Stamp????
