H-4 extension not filed !! Please help

Me and my Wife's Visa and I-94 expires in Feb 2005. My company filed for my H1 extension and I have recieved my approved I-797 . Unfortunately, me and my company forgot to file for my wife's H4 extension.

I am planning to go to Toronto in Jan 2005 for getting my and my wife's Visa stamped, 3 week's before our Visa expires. I have two earlier H1B visa stamped on my passport.

My queries:

1) Could their be a problem with my wife's Visa approval as she doesnot have an approved I797 and that she is not filing from her home country.

2) How long can the consulate take to decide on her and my case

3) What unforseen things can we be prepared for ?

If u don't apply for ur wife's H4 extension , she will go out of status and risk deportation. Why can't u apply now.
My understanding is, she need to have H4 approval paper for stamping. She cannot get stamped with ur H1. It only true for first time stamping.
Wake up and Apply for her H4 ASAP

You can do that. But in case some thing happened and you can't go for stamping, she will be out of status and getting H4 after that will be very difficult. It is very easy to file and you can file yourself also. It costs only $195.00 + Postage. Always better to have H4 extention when there is chance and time. She will get H4 along with you even for 2nd time stamping also.
