Hi Friends,

I was working with employer A for about 3 years and recently changed my employer and they filed a H-1B transfer petition and got it approved. Now i didnot resign from my employer A and was on vacation and joined and worked with employer B for 15 days.

Now due to some unfavorable circumstances, my H-1B petition with employer B is been revoked and they informed USCIS of cancellation of my petition with employer B. Now I am sure my previous employer has not revoked my H-1B petition and my job with employer A is also active.

So can i go back and work with Employer A with out refiling of any transfer petition? or do i need to refile for transfer. ( please note my previous employer - EMployer A is not aware of my transfer yet)

Please advice me asap...iam very tensed..thank you

----------if Employer A has not revoked your H1 petition by writing to USCIS then you can join employer A. No transfer or refile is needed if Employer A has not revoked your H1.

or do i need to refile for transfer. ( please note my previous employer - Employer A is not aware of my transfer yet)

Please advice me asap...iam very tensed..thank you

------- Did you talked to a good lawyer with all your details?
Is there a document that states i don't need a H-1B re transfer.
--------If the H1 Petition filed by Employer A is valid and you have valid I-94 and employer A has not revoked H1 by writing to USCIS then why do you need to do H1 Transfer? Who told you that you need H1 transfer to go back to A in the situation posted by you?
If yes can you please share with me
Go to employer A lawyer or find good lawyer and seek legal advice.

I have not told Employer A anything about the transfer yet- so I'm little concerned now. As what I could do

To clear your concerns you should go to any lawyer of your choice and give your details and and ask the advice by paying lawyer fees . some people don't believe the free advice and some people from India don't believe the doctor if doctor gives free medicine. they believe in doctor who asks big fees and and give the same tablets the other Doctor was giving him free. You must go to good lawyer and clear your confusion.
