H-1B termination and severence package

On Jan 10,2002 I was notified with a letter from my employer that my employment with the company will terminate as of April 30, 2002.
My compensation will continue until the end of April 30, 2002. But I am not required to go to work anymore. My employer will notify INS at the appropriate time.
1- What is my status?
2- How much time do I have to remain in U.S. legally after the termination of my employment at the end of April?
3- Does it matter which type of visa I change to ( F-1 or B-2(tourist)) to stay in US and look for a job.?

1. After Apl30 out of status
2. Officially 10 days. beyond 60-90 days you will be asked to go to your home country (or outside US if I94 is still valid) to get a new I94. Beyond 180 days you will become eligible for the 3 yr Ban.
3. Matter to who and what? A COS to F or B visa and then back to H1 will take a very long time. The first COS might take 6 months to come and the next another 6 months. Once you are a B or F visa holder you have to wait for the new H1 approval before starting to working for the new company. Potentially you might be stuck for 1 whole year (worst case) without a job.
