H 1B recapture plse help me

My husband got his H1 stamped on Feb 2005 but he came to US only in January 2006.Now our visa is going to expire in October 2010.Is it possible for us to apply for H1b recapture? Will we get extension?Plse give me advice in this regard.

---Yes, the lawyer who is going to file H1 should be provided the Entry stamp page of Passport and Copy of I-94(front and back)
Will we get extension?
-------That is up to USCIS and the paper work submitted and at this time you need good lawyer to file H1 extension as USCIS is after consulting companies.
Plse give me advice in this regard.

------ if I-140 is approved or I-485 is filed then one can get 3 year extension of H1. I dont know your full details.
