Hi, need advice and help.

I came to us on H-4 visa, found a job over here and got my H-1b.Since then I have not been to India and my H-1b is not stamped ,and i know that frist stamping is from home town only. Now I have an emergency & needs to go to India.

I was on maternity leave for 2 months as i just had a baby .Now I have to leave for India my questions is :

1.Due to maternity leave, i don’t have last 3 months pay-stubs as i am a consultant & my firm does not pay any bench salary at this economy.

2.Due to this my w-2 are not matching with my lC.

Pls tell me what r my chances of getting the visa stamping!!!!!!
Pls advise & help!!
What should i do??
How should i proceed for such an issue!!!!!!!!!
pls help!!!
thanks!

I don’t see a problem you were eligible for maternity leave according to FMLA and just keep the document or hospital record that you gave birth to baby and was not being paid for 2-3 months having no pay stubs during maternity is not a problem actually one is eligible for 12 week maternity leave according to FMLA

You can leave for India, don’t forget to mention if they ask about 3 missing pay stubs, inform you were on maternity leave and attach the copy of documents like baby hospital birth record or certificate or any other evidence. Don’t forget to get US passport for baby and get 5-year visa from Indian consulate for baby.
Good Luck!!
