H 1B extension----HELP

Hi everyone,

I have a big doubt my lawyer filed my LC on July 24th 2003 and my H1 expires on July 25th 2004, it is said that we can apply for a H1 extension only after 365 days off fileing the LC so when do i have to apply for the H1 extension and do i need to go for the premium processing.

Also I was out of US for nearly 90 days will that help me anyway.Will I be out of status after July 25th 2004. Please advice.

And can i apply for my wife's H4 extension simultaneously.

---- if the lawyer got the reciept of LC filing from SESA or SWA check the date when LC was filed

------ your LC must be pending for 365 days and your 7th year H1 application must reach USCIS before your H1 or I-94 get expired, if you wish you can also go for premium processing(but not must, for your peacce of mind you will get the reults fast)
Also I was out of US for nearly 90 days will that help me anyway.
----- your lawyer can request to recapture 90 days will all profs like stamps on your passports for entry to US and must write the dates on cover letter( I have seen many cases they dongt allow to recpture if the case is not correctly argued by lawyer
Will I be out of status after July 25th 2004.
---- if you dont file H1 extension before I-94 expiry you will be out of status, if you file you will be OK
Please advice.
