My employer(consulting company) applied for H-1B extension in May 2010 under normal, I got RFE in Nov 2010, so replied it in Dec 2010 (within time) and USCIS received it within deadline. After lot of SRs and phone calls to USCIS (California Service Center), I received a denial of my H-1B extension yesterday. My I-94 expired on 10th Oct 2010. I am not sure what I can do next. Am I still legal to stay and work. I read somewhere that I cannot stay more than 180 days after my I-94 expires to avoid future scrutiny from US. Actually I changed my job from one to another during this extension process. I started at new location (different state) couple of weeks back. So my employer mailed affidavit of my petition yesterday at 5 PM to let USCIS know that I changed client to Vermont service center and I received an email from California Service center yesterday evening 7 PM that my H-1B petition has been denied. Waiting for the details in mail. Should get it by Monday or Tuesday.

I really appreciate if someone can guide me in my situation. I don't know what to do next. Should I leave to India. Please suggest.

---------------If your H1 extension is denied and your I-94 expired on 10th Oct 2010 then you are not on H1 status and stop working. for more info talk to your company lawyer
