Hi,

My H-1 visa expired on 10-2005 while i was working in the U.S. My employer assured me that H-1B extension has been filed and is pending approval. However, i was shocked to find out later that an extension was not filed. In fact the company has gone bankrupt. During this period i was continuing to work for and was paid accordingy. As soon as i realized the predicament. I immediately left the country 01-2006 to avoid illegal stay. I want to now return to U.S and work for another employer who is more than willing to sponsor me for a new H-1B. However, i havent told them about the visa situation. What are the options?. Will i be approved for a new H-1B petition and also a visa?. Any help, advise is appreciated.

No problem, you will get your H1 , but you need to get your H1 stamped in your home country.

Thanks for the reply. Do you know if i apply for a new H-1B visa at chennai will they question my stay in the U.S and status with my previous employed?. Do i need to also present the latest pay stubs and W-2 from my previous employer as evidence when applying for the new H-1B visa?. I dont have this as the pay was directly deposited into my bank account and the company did not give me a W-2 before it went bankrupt.
