H-1B Cap

I am currently on OPT (Expires June 20) and started workinng for my company last week. I missed the H-1B cap by a day. Assuming that I apply for my H-1B around Jun 15, is it legal for me to remain in the States (WITHOUT working) while the application is pending? Is working without being payed allowed?

Working without getting paid is still working. Not allowed. Rest has been answered in my other posts.
 
H-1 Transfer

I am a currently H-1 visa worker. My new employer wants me start to work in early March and my current emplyer needs two-week notice to terminate the job. Today is Feb 25, 2004. So I feel time is so tight right now for me to keep everything running.

When is safe to give out the 2-week notice? Can I do this right after sending out the H-1 visa transfer petition? Will I be out of status?

Anyone know how long it normally takes for the INS office send me the case receipt notice?
