H-1B 7th year extension

Hi,

I am still learning about how to get around in forums, so please forgive me if I post this message repeatedly. I got an approved/certified LC from a GC petition sponsored by company A around two years ago. Unfortunately, the petition was discontiuned shortly after that. I am now working for company B in H-1B status. But my H-1B status is going to reach the end of 6th year in January 2003. Company B is sponsoring me for GC application and we filed a LC in July of this year. Under current circumstance, the LC is not likely to be reviewed by DOL until later next year. Is there anyway I can get the 7th year extension, maybe with my old approved LC? Or, is there anyway that I can keep a working status after January 2003?

I appreciate any advice or comment. Thanks very much in advance.

Your EDD need not be approved at the time of 7th year h1 extention.

The only condition is , your EDD (Labor cert) application is received by EDD and acknowledged (not approved)by EDD one year before the 6th year expiry date.

If you are within the range of this one year, you can extend 7th year of H1b.

If not check your old company EDD, nobody withdraw the application, if you have a copy of old EDD approval, you can make a try.

Thank you very much for the reply and the good wish. My attorney has filed the 7th year extension with my approved old EDD (Labor Certificate). Would an approved EDD be as good as a pending EDD more than 365 days?

Hi! I have a question and was wondering if you could help me? Is there any regulation on the 7th year extension based on a EDD sponsored by a previous employer? How the new law signed by President Bush in November of last year apply to this situation? Thanks very much!
