H-1 visa Application

Hi Everyone,

I have one question about my H-1 b visa Application.I am graduating in June 2008.I want to apply for H-1 b in April 2008. I got letter from my college regarding " I am graduating in Jun 2008" but my consultant said we have chances for rejection because they will consider my status in April 2008.

So if someone graduate in June 2008 how would they get letter from school?
Means is that ok to submit the letter which I received from my college about I am graduating in June 2008 and still I can apply for MS Quota H-1B.

Latter if I were get query from IRS, then I will submit my degree certificate.Somebody please guide me in this situation. I really appreciate your help

You are in the same situation as many other college/university graduates - the academic year usually ends in May/June while the H-1B cap is likely to be gone by the time of your graduation.

Because the H-1B cap is likely to be gone in June by the time of your graduation, you are forced to submit in April. However, the problem is that in April you do not have your degree and the USCIS will reject your application.

Are you expecting a Bachelor's or Master's degree? This may make a difference because if you already have a Bachelor's degree then you may be able to apply for H-1B based on your Bachelor's degree.

I have a question about H1B renewal. My HIB visa in my passport expires in June 2008. However, my I 94 shows vaild till January 2009 (the date on my H1B approval notification). When should I file for HIB renewal?
