My wife is on H-4 right now. We are thinking of applying H-1 for her.
I have the following questions:
1. Can we apply for H-1 now and ask for the H-1 to be valid from end of January,2006? Will the application be rejected as the validity date is so far away?
2. If we apply for H-1 now and the validity is from October 1st, can she go to India after the H-1 is approved(leave & return before October 1st)? Will she need to get a multiple-entry H-1 stamping in India before coming back?
