H-1 to F-1 case

My friend will be out of job soon. He is planning to change H-1 to F-1 to keep the status and allow more time to find another job. Thus He only wants to apply for an associate degree in a community college in which cost is cheaper and more flexible. The problem is that he has already get a MS degree in CS. Will INS deny his application if he applies for associate degree in business (or other major except CS)? Any other suggestion?

I know someone who did just that. H1 to F1 to maintain status. It was appoved by VSC. I guess it depends on the INS officer.

How safe is it to change from h1 to f1 considering the present situtaion. I inquired with the college authorities. They want you to give up h1 first and then apply for f1 within 10 days time. Any help is appreciated.

Hi,

I am on H1B and my employer laid me off and they will inform INS on Nov 30 th.
Can I go to Vancouver and get F1 Visa If I have valid I-20 for Spring2002(Jan 2002).?( I already got one MS Degree from Same University)

Will it be a problem If I go to Vancouver, Canada in December 1st week?. OR Do I need to go to India for Stamping..(F1).

How about I-539 (Change og Status) Route ?

Consider Change of Satus (using I-539) - coz the risks are lower. But then you will not be allowed the "benefits" (on campus jobs, Assistantships) of an F1 until your application is approved.

Remember, it takes quite a while for approval too. But if properly filed, with right documentation AND cover letter - should be ok.

Can a person who goes back to a school from H-1B uses the remaining time of H-1B after the graduation?
If so, how can he/she prove the time used and the time remained?

yes you can

Ivy is wrong
when u get ure visa converted from h1 to f1 then u can use the remaining time of h1 after u revert back to h1 ... there is no such condition that u need to have a green card

   see basically when u get ure visa converted to h-4 to f-1 they need a proof of non-immigrant intentions ... u could do this by showing that u have ur family in ure home country or you have property in your home country.

dont worry go to nearest school go register for the major which u would like to join and apply for INS for change of status I539 and ur status will be changed.
once ur application is filled u get ur recipt number ur in F1 and wait for some times u get status of F1
comming to visa if u have to go india go for visa.

Hi,
  I got laid off this month and I have applied for a change of status to F1. I am in Texas where the processing time is 7-9 months for this. My question is, once I get the F1 status will I be able to apply for a job next year, that is change back to H1 or do I have to be on F1 for sometime before I can start working on H1 again. Any info regarding this is appeciated ASAP.

I\'ve been in US on H1 for the last 3 months and just like many in this country I\'ve been on the bench ever since I arrived. I feel insecured being on H1 any further and I wish to get on to F1. While there is a great chance for me to get in to a US school based on my GRE/TOEFL, will there be any problem for the change of status from H1 to F1? Can I obtain F1 from either Mexico or Canada? Suggestions, experiences in this matter would greatly be appreciated.

If I go to my home country, can I have my visa stamped on my passport?

INS asked for additional evidence of residence in my homecountry. My process is still being preocessed.
