H-1 renewal and AP

Here is my situation: my current H1 (first 3 year) expires 11/30 and I plan to travel on AP in November. From what I read in this forum, after I travel on AP, my H1 is still valid. But I need to renew H1. If I renew my H1 now using premium processing, I guess it can be approved before I start my travel.

Gurus, do you guys see any problem with this senario: Have H1 renewal approved (start date 12/1) before I travel, travel using AP, come back on November 20th, still on the old H1, then new H1 automatically starts December 1st.

get your H1B approved using premium processing (if you need H1, and you dont mind spending the extra $1000)

if you Visa stamp in passport is also valid till 11/30, then you may not have to use AP........but keep the AP just in case.....

please try to update this thread with your experience...
 
Thanks techy2468 for the response. I don't have H-1 stamped, that why I plan to use AP.

Let me rephrase my question: I know that I can't travel while H-1 extension is pending. So what if H-1 extension has been approved (using premium processing) but the start date is a future date, can I travel? After I come back using AP, is the H-1 extension still valid?
 
ginnu is right.....it sounds logical that you can travel using your AP.....even if your H1 is gettng extended........unless there is law against it......check with a attorney...
