I have an H-1 re-entry question. A relative of mine
was on H-1 visa for an year in US and he left to
India after working for 1 year. He is in India for past 6 months. His company
didn't cancel his H-1 and he has H-1 multiple entry
visa and is valid until beginning of 2004. He would
like to work with the same company in US and want to
use the H-1 visa for the "re-entry"
The company said they will provide the letter of
employment but they will not be able to provide the
pay stubs for past 6 months, because he was not here in US.
Can he come here and work with the same company ? What
are the valid documents that are required for
"re-entry" ? Can he come here with only a letter from
the company that he is still employed, without the
pay stubs ? Does he need any more documentation from
the company
Please provide any help/suggestions.
