Hi, I have an H-1 that will expire by Sep 2007. (I would have completed six years).

My company plans to file GC sometime this year. I understand that Labor needs to be started 365 days before the expirt to get H-1 extension. Is that true.

Additionally, how long does it take before the filing of labor can be done?

---------- for 7th year H1 extension one needs LC Pending more than 365 days, at this time LC can be filed through PERM it takes 70-80 days to file LC through PERM and LC may be approved in 3-4 months time and then your employer need to file I-140. If your employer file LC through PERM it may get approved and then employer need to file I-140(that takes around 4-5 months for approval. request the employer to file LC ASAP

------ you need to ask your company lawyer. it may take 70-80 days to file LC through PERM.
