H-1 and Advance Parole

Hi All,

I need your help/advice with regard to Advance Parole.

I was in US for 4 years(18 months on F-1 and the rest on H-1). I came here to India in May 09 to get the visa stamped but was issued a 221 g which is still under processing. My question is - Can I ask my employer to file for Advance Parole and can I re-enter US using Advance Prole while my case is under processing? Please advice, thanks a lot in advance.

Advance Parole is filed by YOU if your I-485 is pending. AP should be filed in US and should be approved before your depart US. US employer can’t file AP for you.

I wasn't aware of that. Can I ask my employer to file for I-485 now? Generally, do you havy any suggestions for me to get back into US? I have a valid H-1 approval notice(I 797). Please advise, thank you once again.

How the employer can file I-485 for you? If US employer filed LC for you and that got approved then employer file I-140 for you and you file your I-485.FYI to file I-485 one need his PD to be current and I-485 is filed if you are in US. I don’t think you know about LC, I-140 or I-485.
