I have been to India on vacation on 3 different occasions for a total period of 3 months. Can this personal vacation time be used to extend H-1B1 visa beyond 6 years.
I was thinking of doing the same thing since my H1 expired on the 13th and there were no signs of LC being approved. My lawyer said it is not a valid scenario but we were going to try it so that we could buy sometime for LC to get approved.
Thankfully we did not have to do it as I got my LC approved last month. Now i have filed for 7th year H1 extension based on the fact that LC is approved (took more than 365 days) and waiting for I-485.
