09/99-08/00: Work in Company on OPT
08/00-09/00: Stayed at home with Leave Without Pay waiting for H-1B (OPT expired in 08/00, applied H-1B 05/00, but the H-1B quota were used up in June, got H-1B approval in Sept).
10/00-present: Work in Company on H-1B

In LC I put 10/99-present: work in Company. In the Biographic Form, should I fill the same?? Will INS ask how I had worked between 08/00-09/00? The INS policy at that time said I could wait for the H-1B in US if I filed the H-1B before the expiration of my OPT.

First, you should consult this with a good attorney.

Second, always put the truth on the paper. I think your reason is understandable for INS. In the bio, I do not think it is good idea to put it as work time during that period. It is just my opinion. Good luck to you!

Mention your work history by dates.

split the work history as from 10/99 - 08/00 and 10/00 - till date.
