Just got an email from my attorney saying that my FP2 notice was is received by their office. Whan I asked them to forward it to me, they informed me that my wife's notice was lying in their files. It was scheduled for April 2004. But never received a notice to my address (may be it might have sent to the old address. I filed AR-11 in time, but changed it on phone only in April 2004). Now, the notice clearly says that if she cannot attend the finger prinitng, it is considered that the I-485 application is considered to be abandoned.

What can I do? Please advise... I know, You guys are much better than so called law experts........

I believe you can send a letter to USCIS requesting a notice for fp. You may tell them that you have not received your fp notices.

Hope that helps... good luck.

run to 'FP' center....

run to 'FP' center...even u r late...but u got to have old notice.....& make some nice excuse...like u were in hospital (i'm very sorry to write u like this..but..).....or if this is related to a woman...say I was pregnant.....

I know someone has done it...

thx

ghme_rfe,
Like the other guys said .. get the FP notices from your attorney and just go to the local FP office tomorrow. You can just tell them your stupid attorney did not give you the notices earlier.
Also, ask your a**hole attorney to call INS and tell them that he/she screwed up with the FP and that you guys are doing it this weekend.
You might wanna call the INS too.

How did you not get the copies sent to you? Did you not notify the postoffice about mail forward when you moved?

Hope things work out. Goodluck.

Don't panick. Don't call INS. Just get the notice copy from your lawyer and goto your FP center and get the FP done. Most likely they will accept. If they don't accept, then start talking to INS customer service.
Wish you good luck.

--------------------------------------------------------------------------------

Dear friends:
First of all accept my thanks to all, thsoe are keeping this thread is really valuable source of information to all.
1. ND 03/13/2002 (I140)
2. Then applied I-485 ( ND : 09/23/2002)
3.1FP ( 10/01/2002)
4.RFE on I-140 on march 2003
5. I 140 approved on (09/15/2003) NIW
6. 2FP 05/19/2005
7.RFE I-485 05/27/2004
8.RFE received INS on 06/ 15/2004 ( EVL, J1 Waiver, IAP-66 forms)
My point is how long it will take maximum to get approved. Minimun may be 2 days but I want to know maximum I can expect , if before that, it got approved by GOD's grace ok.
Thanks
Jayram

I think you should definately talk to the attorney (Just to be on the safer side ) whether or not they should informing the INS about missed FP. Because you said "Now, the notice clearly says that if she cannot attend the finger prinitng, it is considered that the I-485 application is considered to be abandoned."

Get the FP done tomorrow ...then you can worry about talking to the attorney and all that.

Big Thanks to all.....

One of my close friends has replied to normal RFE (just pay stubs, tax returns) in last November and nothing happened after that. His FP is still valid.
With INS, it is foolish to carry any expectations.
