My wife is on H4 as of today. Me and my wife got our EADs couple of months back and my wife recently got a job offer to work as an independent contractor (1099, instead of W2). If she joins this company and then loses her job or quits, will she need to leave US and go back to the home country OR she can stay as such in US.
I understand she would have lost her H4 status the moment she starts working, but what happens in this situation. If she is legal to stay then of course Iam assuming she can start working somewhere else also.

Iam on my original H1, haven't used EAD. Our APs are also approved.

She was actually about to start working today but somebody told me last night that if my wife loses her job she will need to go back to the home country. Ours is a sequential 140, 485 case and 140 is approved.

She can stay in USA till her 485 is worked upon and final decision is made. There is no need to leave USA for her, just ensure she has her AP with her while going outside USA.

Does anybody know if the situation changes if 140/485 were applied concurrently. The friend of mine who told me last night actually has his own case as concurrent and is not letting his wife work because he learnt about this rule somewhere.

Ask your friend where he gets such info from? There is no such rule.

----- why he tells you all this in Night? what more he tells you in night please share with us as it may make others more wiser :D

------- he has his own family rules, who will prepare food if his wife goes for work? :D he may not allow her wife to work or use EAD for diffrent reasons, he may be waiting for I-140 to be approved and I-485 hit 180 days. he may be playing safe, becase if his wife uses EAD and I-140 gets denied then she will NOT be on H4 becase she used EAD, he is playing safe and that is correct for him. it is better to wait for I-140 approved and I-485 pending for 180 days becase then one becomes eligible for AC21 and safe to use EAD by H4 hoder but it is always better to maintaion H1 status by primary becase if I-140 is denied then EAD, AP I-485 all will be denied
