Hello everyone,

I recieved a RFE during my I-140 process around Oct 2001. RFE was about few pay stubs, W4 forms, tax returns and company financial statements.
I recieved my I -140 approval in Dec 2001 and filed for my I-485 in Dec 2001.

My question to all Guru's ........... what do you think are the chances in my case of getting an another RFE on employment etc.

Is there any such case, who recieved a RFE during I-140 and same or someother RFE in I-485 procrssing ?

Any inputs will be appreciated.

They have FULL suspicion on U and UR company
So they will ask you in future.
Just have them ready....DEC01 is going to start soon in 3-4 months ?
 
I don't think there is any major pattern of issuing an RFE. Since the 485 is taking so long, INS (BCIS) has become increasingly suspicious if the applicant still has a job and thus is issuing RFE's randomly. Also, it doesn't matter, IMHO, if you work for a small or large company.

Don't get upset, have little patience. I know someone who recieved an RFE during I-140 stage (don't have the details) and also during I-485 procressing for employment letter, pay stubs, W4 forms, tax returns etc. Yet that person got approval. I don't know much about his case so I was bit relunctant to post this reply. All I know is, he had to change the job 2 months after applying for 485, in that process service center was changed too, luckily case was not transferred to the local INS. Currently he is in India, so can't tell you anything more that this right now. But the bottom line is it is possible to get an RFE during both I-140 & I-485 stages and still there are chances that your case will be approved; provided you are able to produce documents they ask for.

I have a similar case (Got I140 approved after a RFE for the W2,Company Tax statements etc..). But I think there is no definite pattern for issuing RFE, if it was so then all the applicants from my company should have got a RFE.

So think +ve and pray to GOD for the BEST.

I got the same RFE in my I-140 stage in Dec '01. We replied with all the docs like company financial statements and paystubs and, believe it or not, my I-140 was approved within 2 days of receipt of reply.
At the I-485 stage I think they are more concerned about you than your company. I guess they want to make sure that you are working and your skill sets are in demand. This rules out the potential problem of you being unemployed and become a state burden. With the economy down they want to be more sure and that's absolutely valid. So RFE for employment verification can be generated for anybody. So it's always a good idea to keep your docs ready. If you are employed and kicking, there's nothing to worry about.
This is just my thought.

Yeah, I am ready for the RFE but was just inquisitive to know how BCIS works?

But I guess you guys are right, there is no such hard and fast rule that one cannot have 2 RFEs. Its just matter of luck.
