My friends family went to India on Vacation both (Green Card) holder , Wife is Pregnant due in Jan . Due to some Complication is not allowed to travel back to USA before Delivery .

Now what will be the status of child born to a Green Card Holder ,
For his wife i Think they might need Re-entry Permit since stay will be more that 6 Months , How the new born will be allowed to enter USA .

Hi

Your friend need not worry. His wife can have a safe delivery in India. She does not need a re-entry permit if she stays out of US for upto ONE year. If she has to stay more than a year then she will need the re-entry permit. She has a valid reason so she can get the re-entry permit at US consulate in India also.
Their baby will get a PR status at the port of entry in US. If PR parents have a baby outside of US and parents come back to US with the baby and baby is less than 2 years of age then baby gets the PR (status) stamp on the passport at the port of entry. But ask your friend to check with a lawyer or consulate office in India before he come back to US with his baby, may be there are some other formalities involved in this procedure.
