Gurus, Plz HELP… Attorney not helping at all…. Travel Questions

Hi All,
I have few questions as I will be travelling out of country soon. My attorney is not willing to help when i asked these questions.

1. Myself and my wife are having valid visas upto Sep 2002. We will be
  coming back on April middle. We both got already our AP approved but
  thonking of using visas only for the time being. Whether is it OK to use
  visa or is it better to show AP and reenter.

2. Whether r they asking original 485 receipts at POE. If they didn\'t ask
   also, Is there any need to show it to POE officers. And also is copy of
   485 receipt is enough (because attorney is not giving original one)

3. While coming back our I-94 will change again. Whether that will create
   any problem to 485 application.

4. As my wife will be staying there for some more days, meanwhile if GC
   got approved , will there be any problem for her to re-enter US. Any
   other procedures are there?

5. As i won\'t be getting payments at that time, whether that will cause
   any problem to GC?

Please share your experiences and suggestions. I am planning to travel out of country on March 1st.

1. Yes you can use visa.

2. Normaly they don\'t ask. If they ask you can show AP and 485 receipt.

3. No problem. Most of my friends went out more than once.

4. I think it will not create any problem. One of my friends wife went twice to india after applying 485
    and they got approval last week.

5. Will not create any problem.
 
That\'s right.

I also went to India after applying 485 and came back on H1.

If you are not in EAD, you can come back on your H1. It\'s always better to carry your AP, EAD and other documents.
 
Travel Question of Portal

This is in response to the travel question.

I travelled to India and returned very recently. I did not have an AP as I had not applied for one. My H1 hsd also expired - though I had an new H1 approval.

I had to go and hence took the risk. There were NO issues in Mumbai in getting my H1 stamped,

Though I had carried my I 485 - there were no questions at the port of entry - SFo.

If you use your AP I believe you will lose
your H1 status.

I think this also applies if you lose
your EAD card.

So come back on your H1-B visa.
