Gurus, Please help

Hi All,

My Labor is pending at Atlanta, and hopefully would get approved soon.

This labor is from my previous company and recently I joined the new company.
( due to my client policy, They forced us to chage the company ).

My old employer is ready to support the GC process and saying that he will continue my GC process as long as I'm paying for that.

My question is that:
Can I apply for 140/485 based on the labor from my old company. ?
Or
Do I've to opt for "Condular Processing" because I'm not with the same company.

Will there be any RFE regarding W2 in future, and if there is RFE regarding W2 and I don't have W2 from this old company, but have W2 with some other company.... what would be situation..

I'm just worried..

will really appreciate your help..Please response..ASAP..

u have many options all u need to be smart.


1. ask ur new employer to file labor cert and then 140 then 485.

2. keep continue ur current work.

3. as long as ur old emp support thats good. ur concern about W2 then u have option if new emp don't help to in ur GC.

Option#1. ask ur new empl to pay ur check to old emp as 'corp to corp contract' and u get check from ur old emp. this way u will get w2 from old emp, they alredy supporting u they would give EVL+W2... :D .

Option#2 if new empl don't support ur GC (LC 140 485) and reject to help. and also reject to go 'corp to corp contract'
Then either u can still continue work and pary for W2 it will never be a issue for u . or somehow u and ur old empl figure it out how to deal wiith W2. u know what I mean ? :D

I have seen ppl who were in worst /weaker cases and got approval.......
keep ur chin up, trust on God there is a lot of ways to solve this issue
all u need to find it.

Corp-to-Corp is not possible as we tried ( My old employer as well as new employer, this is a client problem and he is not allowing it ).

My new employer is ready to file the fresh Labor, My only concern with this is that this will again gonna to take another year or two for me.

Right now the situation is like that my previous employer is ready to continue the process as long as I'm paying the expenses and I've to sign a paper where he is stating that I've to work with them at least for a year once the GC is approved, This is a big consulting firm..

New employer is also a consulting firm, But not that big as the previous one,
But he is applying the fresh labor...

What I'm trying to do here and if GOD will help me here...

I want to continue the current job, and want the new employer to file the fresh labor.
Whereas if the previous company's labor gets approved, then I want to file the 140/485 with previous employer.. and start a Job search with the previous employer...But the Ideal situation would be....To continue this Job with current employer, while the 140/485 is pending with previous employer..

Only concern, If there is an RFE corresponsing to W2 at 485 stage and I'm not an employee of the company who is sponsoring for me....then How to handle that situation..

At present , I've three W2's from my previous company, while this is it will be
two w2's, one from previous company and one from current company..

Let's say I got an RFE in Jan-Feb'2006 regarding W2 of 2004...

and at that time I'm not working with the employer who sponsored my GC, then I think I would be in problem..

Please suggest.
