I've got my I140 approved and ready to file for I485. However, I have an unique situation.
I had an approved I730: asylee relative petition based on my marriage 5 years ago. However, the marriage was annuled in less than a year.
On I730, it assigns an Alien number to me. Do I have to put this A# on my I485? Since marriage was annulled, arguably, I should not be approved I730 anyway.
My attorney advised me to put it on the form. But put my status as single since annulled marriage means it never occurred.
She and I also have a split opinion on whether we should include copies of annulled marriage certificate and form I730.
I think I have three options:
1) Not filling in A# on I485 form. Not disclosing any info. regarding annulled marriage (the attorney strongly against it)
2) Filling in A# on I485 form. But not sending in copies of I730 and annulment. Wait to see if USCIS asks for it (My attorney strongly favors this)
3) Filling in A# on I485 form. Sending in all info. plus a letter explaining the annulled marriage. (The attorney doesn't favor this. She thinks that it's not necessary)
I've read many posts here. Many of you give advices better than any legal service that I could have had. Can gurus here help me? I'm in desperate need of an answer! ;-)
Thanks!
