Hi,
my labor certification is from Delaware and i am working for a client of my company in California. My Companys attorney filed the I140/I485 to CSC with ND Oct 03 2003. i got the EAD in Jan and FP done in April and i confirmed with
USCIS cust service guys that filing like this to a different center is fine.

Now i got emails that my I-485 is transferred to Vermont. There is no
status update of my I-140 though. i dont know whats going on.

could somebody explain these things to me..

Crazion - So, your company is in Delaware but you are working for a client in California? If yes, then I think they usually transfer cases like this. On the other hand, if the company is based in California and you are working at a client side, like say - Delaware, then it should be okay to file in California, I guess. This is my understanding and I have been wrong before. Any other ideas folks?

i thought they should have not accepted the case in first place.
but they did and after almost 1 year and having given me EAD and done the FP, now the 485 is transferred. they havent anything to I140 yet. may be it will also get transferred.

Does any one know if my filing dates for I-140 and I-485 would stand or am I
going to lose 1 year of processing time.

thanks

Crazion - So, your company is in Delaware but you are working for a client in California? Is it correct?

A friend of mine works for a company based out of California, but was working at a the company's office in Florida (its a worldwide company with offices everywhere) The labour was aproved in Florida, and the I-140 and I-485 were sent to the California Service Center. She changed jobs using AC21 to a company based in Florida, and now she recently got the green card approved from CSC, no transfer at all.

Transfers do not always happen in these cases.

Its one of those CIS acts that does not hold any reasoning. In my case the Labor is filed in NC, I've been living in CA. My lawyer filed I-140 and I-485 from CA and they are approved without problem. And same thing happened in other cases to.

One good thing is your filing date at Vermont is same as the one at CSC.

hi ,
yeah, nobody knows the vagaries of USCIS.
do you know if they would be issuing new Reciept Number ?
also if they do honor the original Filing Dates of I-140 and I-485, wouldnt that
mean that my I-140 is immediately approvable ? [ btw I-140 is not transferred yet , i dont know if they would ]

could someone post details if they had similar experience.

thanks
