Gurus, please help me how to submit ref on legal staus

Anyone know about Officer #0020? Will I face legal status challege on 05/2001?

All,

I just received the ref letter to submit proof of legal nonimmigrant status in US for periods 04/1997 through 05/2001.

I came USA as F2 in end of 1995 and went to school between 08/97 to 05/2000 then worked on OPT(Optional Practice Training with EAD) from 05/2000 to 4/30/01. But my company delayed my H1b application till late April, 2001. So my receipt date on the H1b approval notice is May 15, 2001 and the approved date is July 9th, 2001 and it was valid from July 9, 2001. I don't have the receipt notice. The actual received date could be earlier than May 15, 2001. So how to provide the proof of 05/2001? Do I have to provide the proof of May, 2001 since the periods is 04/1997 to 05/2001?
Except I-20s, what I need to submit? I meant that I have to submit EAD, F1 approval notice?

A copy of approval for work authorization/OPT & a copy of approval for your H1-B.

Plus, given the late start date of your H1-b (July 2001 rather than May 2001), you may be better off to include a copy of the receipt notice for the H1-b application. Once the application is received, you are in a status (i.e. pending status). So you were never out of status even though there was a gap in your employment. Just explain what you posted in your cover letter.
I don't see any serious problem in your legal status!

Will INS challenge my legal status on 05/2001 since my H1B receipt date is May 15, 2001 and if I don't have the receipt notice or the received date is later than May 1, 2001 after I get it from the company lawyer?

your EAD expired on 04/30/01 and your company applied your h1-b sometime in May- that shows there is a gap. However I think you are fine. Since there is 60 day grace period for f1 student and the out of status day only start counting from 61st day. Moreover you h1-b pettition was approved with new I-94. I would only start to worry if I were you if there is significant out of status situtation(more than six months) . Like hanging in there said you were never out of status. Just explain in cover letter nicely. I know it's easier said . But I hope this helps you.

I just got a fax of the receipt notice and the received date is May 1, 2001 on the notice. It looks like it was just on time.
